This is the Privacy Policy of Vyrtual LLC (hereafter referred to as “Vyrtual”, “Company”, “us”, or “we”). This Privacy Policy describes how your personal information is collected, used, and shared when you use our streaming service, “Vyrtual™ TV Service” an online platform that allows consumers like you to view video programs (“Programs”) from content owners and licensors (“Producers”) through Producer-branded websites and applications that we power, including without limitation www.Vyrtual.tv domain, our mobile optimized websites, mobile applications or blogs (together the “Website” or “Site”). This Privacy Policy also applies to our ticketing platform, VyrtualTickets.com, which enables users to register for and purchase event tickets, and allows event organizers (“Vendors”) to list, manage, and monetize their in-person and live-streamed events. Users of this platform include both Customers (ticket buyers) and Vendors (event hosts and organizers).

Vyrtual™ This Policy applies to information we collect:

  • On this Website and its sub-domains.
  • In email, text, and other electronic messages between you and this Website.

It does not apply to information collected by:

  • us offline or through any other means, including on any other website operated by Company or any third-party; or 
  • Any third-party, including through any application or content (including advertising) that may link to or be accessible from or on the Website.

If you do not agree with our policies and practices, your choice is not to use our Website. By accessing or using this Website, you agree to this Privacy Policy. PERSONAL INFORMATION WE COLLECT

When you use the Website, we collect the following types of personal information:

  • Limited Payment Information – your payment information goes directly to a payment processing company who is responsible for keeping your info safe. We will not store or collect your payment card details.
  • When a Customer purchases a ticket to an event listed on VyrtualTickets.com, we may share certain personal information (such as name, email address, phone number and ticket purchase details) with the corresponding Vendor (event organizer). This is done strictly for event management purposes such as communicating updates, confirming registrations, or delivering event services.
  • Vendors are independently responsible for how they use this information. While we require all Vendors to comply with applicable data privacy laws and our Terms of Use, we do not control or assume responsibility for their practices. Customers should note that all Vendors must comply with this Privacy Policy when operating through our platform.

Account Registration Information

In order to sign up for a free trial or make a purchase, you must create an Account by providing us with your email address and a password. You may also create a username and upload an avatar to use for comments or forums. 

Payment Information

You must also provide valid payment card information if you wish to sign up for a free trial, subscription, or make any other purchase. Except for the name associated with your card and information about the transaction (e.g., time of transaction, amount), payment card information is collected directly by a third-party payment vendor and is not received or stored by us. 

Information Collected Automatically

Each time you visit the Website, we automatically collect certain information about your device and your interaction with the Website. Usage Data is collected automatically when using the Website. Usage Data may include information such as your Device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Website or Website that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. VENDOR ACCESS AND RESPONSIBILITIES

When a customer purchases a ticket through VyrtualTickets.com, we may share limited personal information such as name, email address, and order details with the applicable Vendor. This information is shared solely to facilitate event-related communication, such as sending updates, confirming attendance, or providing customer support.

Vendors are permitted to use this information only to manage their event and fulfill their obligations to customers. They are not allowed to use customer data for unrelated marketing, resale, or any purpose that falls outside the original transaction.

Vendors must comply with this Privacy Policy when using customer information collected through our platform. All data shared with Vendors is governed by the terms set forth in this policy.

DISCLOSURES TO THIRD PARTIES

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms and Conditions or Producer Agreement and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and Point risk reduction.
  • In good faith belief that such disclosure is necessary to prevent or investigate possible wrongdoing in connection with the Website.
  • For Vendors and Producers operating through our platform, a Data Processing Addendum (DPA) may be required to ensure that any personal information shared with them is used solely for the purpose of fulfilling the associated services, and in full compliance with applicable data privacy laws and business requirements.

TARGETED ADVERTISING

The Company currently does not sell, rent or share its customer lists or any Personal Information of its customers to third parties for marketing or commercial purposes. However, if we were to undertake any such activity, or We may use your personal information to provide you with targeted advertisements or marketing communications we believe may be of interest to you, we want to make sure we provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

EMAILS

We may send you communications (including emails, phone calls, text messages, push notifications, and snail mail) to your Account and transactions initiated by you (such as order status updates and billing receipts). Transaction Emails: When you first create an Account, we may send you a welcome email that provides information about your subscription and your Account. If you make a purchase, we may send you an email confirming your purchase. We may also send you other emails concerning your Account status and renewals. Marketing Emails: Depending on your preferences, we may send you emails letting you know about new programs or features, or promotions. You may opt out of these emails at any time in your Account settings. 

YOUR PRIVACY RIGHTS

You may change your Account information or close your Account at any time by logging into your Account and adjusting your Account settings. If you close your Account or request that we delete your Account, you may lose access to content you have purchased. When you close your Account, we may preserve your Account information to (i) let you know about new offers and content; (ii) restore your Account, if you ever wish to re-subscribe; and (iii) where we believe in good faith that preservation is necessary to enforce our rights.

If you are a resident of the European Economic Area (EEA), you have certain data protection rights. We take reasonable steps to allow you to correct, amend, delete or limit the use of your Personal Information. We process personal information to fulfill contracts with you and to provide Websites you have requested (for example, to fulfil a purchase), or otherwise to pursue our legitimate business interests.  Note that your information will be transferred outside of Europe, including to the United States.

CALIFORNIA USERS

Although you do not need to have an Account to submit a request, we may not be able to locate certain information to process your request if you don’t have one. 

NEVADA USERS

Nevada residents have the right to opt out of the sale of certain “covered information” collected by operators of websites or online Websites. We currently do not sell covered information, as “sale” is defined by such law, and we don’t have plans to sell this information. 

CHILDREN’S PRIVACY

Our Website does not address anyone under the age of 16. No one under the age of 16 may provide any personal information to or on the Website. We do not knowingly collect personally identifiable information from anyone under the age of 16. If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us using the information in the “Contact Us” section of this Policy. If you are under 16, you must immediately leave this site now and do not use or provide any information on this Website or through any of its features, do not register on the Website, do not make any purchases through the Website, do not use any of the interactive or public comment features of this Website, or provide any information about yourself to us. 

We use age verification services, where required, and credit card to prove age, as well as require Producers to provide a copy of their current government issued photo identification in order to ensure our users and Producers’ compliance with applicable legislation. Anyone under the age of 16 is not legally permitted on the Website for any reason, and if we find you on this Site, we will report you to law enforcement as noted above. We will not reactivate you for any reason ever. We also recommend that Users implement parental control protections, such as computer hardware, software, or filtering services, which reduce the opportunity for minors’ access to Site.

If we become aware that we have collected Personal Information from anyone under the age of 16 without verification of parental consent, we take steps to remove that information from our servers.

RETENTION OF YOUR INFORMATION

We will retain your Personal Information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.

We will retain your Personal Information for as long as we consider it necessary to:

  • Enable you to use our Websites and provide our Websites to you, including maintaining your Account.
  • Comply with our legal obligations. For example, we may keep some of your information for tax, legal reporting and auditing obligations. 
  • Conduct our business and for our legitimate business interests, such as establishing, exercising or defending legal claims, chargeback prevention, fraud detection and prevention, hindering any other illegal activity on our site, and enhancing safety. For example, if we close or suspend your Account for fraud or illegal activities, we may retain certain information about you to prevent you from opening a new Account in the future. Such information shall also be kept available in case of ongoing judicial proceedings/and or investigations. As part of our fraud detection and prevention process, we also blacklist all former usernames for a certain time. Therefore, a former username cannot be used for a new registration.
  • Protect our site and your personal information from accidental or malicious loss and destruction. Residual copies of your personal information may not be removed from our backup systems for a very limited time (usually 30 days). Some copies of your information (e.g., log records) may also remain in our database, but are disassociated from personal identifiers.

We will also retain Usage Data and Other Information you provide to us for internal analysis purposes. Usage Data and Other Information that personally doesn’t identify you is generally retained to strengthen the security or to improve the functionality of our Website. We may also be legally obligated to retain this data for longer periods. Take note that neither Usage Data nor Other Information is in any way associated with any personal identifiers and is retained by us to improve the quality of our Website.

PAYMENT PROCESSORS

We provide paid products within the Website, including on VyrtualTickets.com and Vyrtual.tv. We use third-party services for payment processing (e.g., payment processors such as Stripe for web transactions, and Apple or Google for in-app mobile purchases). We do not store or collect your full payment card details. That information is provided directly to our third-party payment processors, whose use of your personal information is governed by their respective Privacy Policies. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of payment information. In-app purchases through mobile devices may also be subject to Apple App Store or Google Play transaction fees, which are set by those platforms.

SALE OF PERSONAL INFORMATION

The Company currently does not sell, rent or otherwise communicate its customers’ Personal Information to third parties for monetary or other valuable consideration.

“DO NOT TRACK” POLICY 

Our Website does not respond to Do Not Track signals. Instead, we adhere to the standards set out in this Privacy Policy and offer the opt-out choices described above.

Vyrtual™ is based in the United States. We make no claims that the Website or any of its content is accessible or appropriate outside of the United States. If you access the Website from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

Our Website may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third-party’s site. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or Websites.

We may update our Privacy Policy from time to time. If we make material changes to how we treat our users’ personal information we will notify you by posting the new Privacy Policy on this page. We will let you know via email and/or a prominent notice on our Website, prior to the change becoming effective and update the “Last Modified” date at the top of this Privacy Policy.
